    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

See my thread of a year and a half ago covering the same point as your post

My Son completed the Awareness Course (on-line) and, as suggested by Man in the Middle, nothing further was heard.

It might be different if your speed was over the limit for offering a Course, or the Police Force concerned does not offer them.

As an aside, ensure the forms requesting Driver details are completed and returned within time.

Currently facing a similar situation to what your son had to deal with,

is there any chance you can pm me as I do not have this ability yet due to being a new member

Hello, welcome to CAG.

There's no need to give or receive advice away from the forum. Much better for advice to be open and available for anyone else who might need it. Also, advice can be checked to make sure it's right.

Please start a new thread of your own and people will be happy to help you.

Best, HB

Would appreciate any advice/info here

Caught doing 53 in a 40 driving my mums car which I would normally have temporary insurance on however now that I've gone back and checked, I've realised the payment did not go through before I made this trip.

Whats the likelihood of the insurance issue getting noticed?

There is obviously an active policy in my mums name but I am not covered on it.

Clean license, held for just over a year.

how long ago?

was this an already running temp ins? just payment failed?
it might well be if you pay and quick, it might well be back dated for you.

did they not write and tell you it had failed.?

  • dx100uk changed the title to Speeding (53/40) and insurance - driving mums car - temp ins payment had failed too!

why did you not realise it had not been granted because the payment failed,

did you not get an immediate temp cover note to your phone saying it's in place?

you must have been be issued with something in case you are stopped. ?

have you that?

it could simply be a case of ringing up the ins co. and paying it, stating sorry you didn't realise they did not get the payment, but i did drive the car that day

have you had any notification since that it was voided for that day?

as for the s172, have you responded yet? it will only be 3 points for that.

I didn’t see that any money had left my account and nor did I have any confirmation in my email

I assume i selected the wrong card and it had sent me back to the payment page to try again but in my haste to leave the house, I didn’t check.

I know this is not an excuse and that I should’ve been more careful.

The nip has been sent back with the nomination

Forget the insurance aspect for a moment.  As you can see from the earlier thread you found, it is not usual for the police to check insurance as part of a straightforward speeding matter. There is nothing you can do about it now anyway.

Instead you should concentrate on making sure that the speeding matter is progressed with no delays or hitches. You said the nomination has been completed and returned (presumably by your mum, naming you as the driver). You will now need to wait for your own "Request for drive's details" .

If it does not arrive within a couple of weeks contact the issuing ticket office. When you have it, return it pronto. Keep a copy and get a free certificate of posting from the Post Office.

You should be offered a course for that speed. It is just on the upper limit. The alternative is a fixed penalty (£100 and 3 points).  Again, keep an eye on this. The offer should arrive within two or three weeks of your confirmation that you were the driver..

The important thing is to keep on top of this. The last thing you want is for any delays (in either direction) opening the possibility that more enquiries will be made.

Thanks,

if I understand correctly, a new nip will come to me (which will confirm what they’re going to prosecute me for),

I then send my details off and the next thing that will come is the offer to do the course or take the points and fine?

And this should all be done with in a month or two?

Correct.

You must confirm you were the driver and then the police will make whatever offer they decide.

It should be a course as they are normally offered up to (and including) 53mph in a 40mph limit.

The main thing is that you need to ensure this is dealt with as a "straightforward" matter with no hitches.

The first job is to make sure you get your own NIP/request for driver's details, complete it properly and sign it.

This might be a stupid question but my mum told me she’s sent the nip via special delivery and the ticket office address is a P.O. Box. As it requires a signature to be delivered is this going to be an issue?

no they just ignore the sig requirement.

thats way 9/10 signed for is a waste of time.

use free proof of posting at po counters.
